Welcome to Zero Day Securities ("Zero Day", "we", "us", or "our"). These Terms of Service ("Terms", "Agreement") govern your access to and use of our website, cybersecurity consulting services, security assessment tools, and automated security scanners accessible via https://zerodaysecurities.com ("Website", "Platform").
By accessing our Platform or utilizing our security services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms.
1. PREAMBLE, LEGAL BINDING & ACCEPTANCE OF TERMS
This Agreement is entered into between you ("User", "Client", "Organization") and Zero Day Securities, an enterprise cybersecurity organization operating in India.
This Agreement is executed pursuant to the Information Technology Act, 2000 ("IT Act"), the Indian Contract Act, 1872, the Digital Personal Data Protection Act, 2023 ("DPDP Act"), and applicable regulatory requirements of the Republic of India. If you do not agree with all terms herein, you must immediately cease accessing or using our services.
2. ELIGIBILITY & ENTERPRISE USE REPRESENTATIONS
Our cybersecurity services and security scanning tools are designed primarily for enterprise businesses, professionals, developers, IT administrators, and authorized security researchers.
By using our Platform, you represent and warrant that:
- You have the legal capacity to enter into a binding contract under applicable law;
- You possess explicit authorization to request security assessments for your specified digital assets;
- All information you provide to Zero Day is accurate, complete, and up to date.
3. SCOPE OF CYBERSECURITY SERVICES & SECURITY TOOLS
Zero Day provides cybersecurity risk assessments, penetration testing, vulnerability management, cloud infrastructure audits, API security reviews, AI/LLM threat evaluation, and automated website security scanning.
Specific service engagements may be governed by additional Statements of Work (SOW), Non-Disclosure Agreements (NDA), or Master Services Agreements (MSA) executed between the Client and Zero Day. In the event of a conflict, the terms of a mutually executed written SOW or MSA shall take precedence.
4. EXPLICIT AUTHORIZATION & PERMISSION TO SCAN WARRANTY
The User strictly warrants and represents that they own, operate, or possess explicit, written legal permission from the system owner to test, probe, analyze, or scan any URL, hostname, domain, API, server, or digital asset submitted to Zero Day tools.
Prohibited Scanning & Unauthorized Testing Notice
You must not use Zero Day services or scanners to test systems without authorization, conduct denial-of-service (DoS) attacks, exfiltrate private data, circumvent security controls for malicious intent, or violate statutory computer misuse laws.
Zero Day reserves the absolute right to block IP addresses, terminate accounts, or report unauthorized penetration attempts to statutory law enforcement agencies.
5. TECHNICAL FINDINGS, RISK SCORES & ADVISORY DISCLAIMER
Security assessment findings, vulnerability reports, risk severity scores, and remediation advice generated by Zero Day are technical advisory guidance provided to assist organizations in mitigating risk.
Security findings shall not be construed as a formal guarantee of complete immunity from cyber threats, legal advice, regulatory approval, or a guarantee that no undetected vulnerabilities exist. Automated scanners may yield false positives or false negatives, which should be validated by qualified security professionals.
6. PROPRIETARY INTELLECTUAL PROPERTY RIGHTS
All content, trademarks, software code, scanner algorithms, design assets, brand logos, vector artwork, and documentation on the Platform are the exclusive intellectual property of Zero Day Securities and its licensors.
Users are granted a limited, non-exclusive, non-transferable, revocable license to access the Platform solely for intended cybersecurity evaluation purposes. Reverse-engineering, decompiling, or copying scanner tools or UI code is strictly prohibited.
7. CONFIDENTIALITY & CLIENT DATA PROTECTION
Zero Day treats client penetration testing reports, vulnerability logs, and technical assessment artifacts as strictly confidential information. We implement technical and administrative safeguards (including TLS encryption, role-based access, and least-privilege controls) to safeguard confidential client data.
8. LIMITATION OF LIABILITY & INDEMNIFICATION
To the maximum extent permitted under applicable law in the Republic of India, Zero Day, its directors, security engineers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, system downtime, business interruption, or data corruption) arising out of or related to your use of the Platform or security tools.
The User agrees to indemnify, defend, and hold harmless Zero Day Securities against any third-party claims, legal demands, liabilities, or regulatory penalties resulting from the User's unauthorized scanning of third-party infrastructure or breach of these Terms.
9. TERMINATION & SERVICE RESTRICTIONS
We reserve the right to suspend or terminate your access to the Platform or security scanner tools immediately, without prior notice, if we reasonably suspect unauthorized scanning, abusive behavior, security violations, or breach of these Terms.
10. GOVERNING LAW, STATUTORY GRIEVANCE DESK & EXCLUSIVE JURISDICTION
These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India.
